P3
Legal
& Ethical issues
In terms of photo shoot, this might be in terms of
misrepresentation, copyright, royalties
LEGAL
In terms of
legal issues, these tends to be about who owns the rights to something, or
whether you are slandering (saying something about someone that is not true),
or sometimes it can be a legal issue of making sure your content is not
breaking the law (as in there is no suffering to animals depicted)
ETHICAL
Ethics are
more of a minefield and there are certain ethical considerations that we have
in the west that are important to understand. Ethics is about what society
views as right.
Such as –
is there a balance between male/female genders
If there
are, are these stereotypical roles (eg
powerful and strong male, weak female
often dressed provocatively)
Is there
swearing, are there weapons?
Southpark
is controversial because a lot of people disapprove of its ethics. However, the
producers might argue that it is for a small cult audience who are adult enough
to know what is right and what is wrong.
What are
the legal and ethical issues of your production and can you justify them?

LEGAL
|
Issue
|
Solved or
justified?
|
|
Taking
photos and filming in public or private land and using the material without
permission
|
Solved,
because we have used the photography studio with permission from the photography
technician, and the photographs were taken in the given time span.
|
|
In-sighting
religious and racial hatred
|
Solved,
by not using any triggering or offensive material on the poster, such as no
religious symbols shown in a bad way or showing racial colours in a bad way
(black person loosing and white person winning)
|
|
Credit
block used
|
Solved,
by writing the text in a similar colour to the background, which means you
have the legal product intertwined with the overall film print product. It means
the company/studio is happy that their information is present and that the
names of the major people in the cast and crew is present. The audience will
be happy to see nothing stands out against the images of characters.
|
|
Using a
logo or company without permission
|
Solved by
editing out the company name or logo on Photoshop and it could be justified
by getting the permission to use the logo or company name.
|
ETHICAL
|
Issue
|
Solved or
justified?
|
|
Not
including the age rating on a poster or advertisement for warning, so people
below that age are turned away.
|
Solved by
a putting the age rating beside the film title or in a clear place near the
credit block, so it stands out more. It would be justified by using images
that clearly show what is involved in the film, and not glamourizing the film
to make it look cleaner or appropriate for young children when it isn’t.
|
|
Gender
inequality
|
Solved by
showing both genders in equal ways and not discriminating a gender, such as a
male majority and one female character shown. Justified if I have only one
female character to show out of three main characters, two of which are male,
and it is the only way to show the characters.
|
|
Showing
an offensive image or being offensive in any way in the poster
|
Solved by
using safe images and no striking positions with hands or facial expressions
which could be interpreted as offensive. Never using any offensive language
used in the film on the poster.
